CONDITIONS
1. NUMBER OF LESSONS
The Student (or the Student’s parent or guardian) will be give the opportunity to book lessons via the Availability Matrix throughout the academic year. By it’s nature regular lessons may not always be possible.
2. LESSONS
a. The Teacher will give the lessons at the location specified overleaf or online via Zoom and at the times and dates as notified to the Student (or the Student’s parent or guardian). Lessons times will be confirmed once payment has been received in full.
b. Lessons will take place on public holidays or outside of the Term only by prior agreement between the Teacher and the Student (or the Student’s parent or guardian).
3. FEES
a. Lesson fees will be charged at an hourly rate which will be pro rata for lessons of less than, or more than, one hour duration.
b. Lesson fees applicable at the start of this Agreement will be confirmed in writing in the first invoice issued by the Teacher to the Student (or the Student’s parent or guardian where appropriate).
c. The Teacher may increase the tuition fees from time to time and will give written notice of such an increase to the Student (or the Student’s parent or guardian where appropriate) by no later than the end of the Term preceding the Term when the increase takes effect.
4. PAYMENT
The Student (or the Student’s parent or guardian) will receive an invoice for lessons requested. Once this invoice has been paid in full, confirmation of the lesson requests will be made.
5. LESSON CANCELLATIONS AND RE-SCHEDULED LESSONS
In the instance of a Student attending lessons on an individual basis:
a. If a Student (or the Student’s parent or guardian) cancels a lesson with more than FORTY EIGHT (48) hours notice, the lesson will be re-scheduled to another date.
b. A Student is allowed ONE (1) re-scheduled lesson per Term. Any subsequent lessons cancelled by the Student (or the Student’s parent or guardian) will not be re-scheduled and will be charged.
c. If a Student fails to attend a lesson, or a Student (or the Student’s parent or guardian) cancels a lesson with less than FORTY EIGHT (48) hours notice, or if a Student fails to attend a re-scheduled lesson, or a Student (or the Student’s parent or guardian) cancels a re-scheduled lesson, the lesson will be charged.
d. If the Teacher cancels a lesson, the lesson will be re-scheduled to another date. If this is not possible, any fee already paid will be refunded or used to pay for a future lesson.
In the instance of a Student attending lessons as part of a shared group:
a. Each Student is deemed to have paid for a pro rata proportion of the total lesson duration.
b. If a Student (or the Student’s parent or guardian) cancels a lesson with more than FORTY EIGHT (48) hours notice, the lesson will be re-scheduled to another date, equal to their pro rata proportion of the original group lesson. The original lesson will remain for the other Students of the group and will have a pro rata reduction in duration. It is the responsibility of the Student (or the Student’s parent or guardian) cancelling the lesson to ensure this reduction in duration is communicated to the remaining Students.
c. A Student is allowed ONE (1) re-scheduled lesson per Term. Any subsequent lessons cancelled by the Student (or the Student’s parent or guardian) will not be re-scheduled and will be charged.
d. If a Student fails to attend a lesson, or a Student (or the Student’s parent or guardian) cancels a lesson with less than TWENTY FOUR (24) hours notice, or if a Student fails to attend a re-scheduled lesson, or a Student (or the Student’s parent or guardian) cancels a re-scheduled lesson, the lesson will be charged. Any remaining Students of the group will be taught for the original duration of the group lesson.
e. If the Teacher cancels a lesson, the lesson for the whole group will be re-scheduled to another date. If this is not possible, any fee already paid will be refunded or used to pay for a future lesson.
6. PHOTO/VIDEO/AUDIO PERMISSION
On occasions the Teacher may take photographs/video/audio recordings of the Student for the purpose of training and promotion. These photographs/video/audio recordings may be made during lessons, workshops or performances.
7. TERMINATION OF LESSONS
a. This Agreement may be ended by mutual consent at any time by both signatories to it signing and dating a written statement to that effect.
8. CONDUCT
If the Teacher, using their reasonable discretion, feels unable to continue tuition on account of conduct by the Student or anyone connected with the Student which makes it unethical or unsafe to continue teaching the Student, the fees for any outstanding lessons will not be refundable.
9. CHANGES
a. Any changes to the terms of this Agreement must be confirmed in writing and signed and dated by both the Teacher and the Student (or the Student’s parent or guardian).
b. If the Teacher chooses to waive any right or remedy under this Agreement or otherwise (for example, if the Teacher chooses to waive fees for any lessons which the Student (or any other Student) does not attend) this shall not mean that they must do so in future or that they waive any other rights or remedies, unless agreed in writing in accordance with Condition 7(a) above.
10. GOVERNING LAW AND JURISDICTION
This Agreement shall be subject to the laws of the jurisdiction of the location for the lessons (specified above) and the signatories to this Agreement agree that any dispute relating to the subject matter of this Agreement shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
11. GENERAL
a. The Student (or the Student’s parent or guardian) agrees to pay for any music/strings/reeds/repairs etc. required by the Student and provided by the Teacher.
b. The Student (or the Student’s parent or guardian) will be responsible for any loss or damage incurred to any instrument, accessory or music loaned by the Teacher to the Student. Such items will be returned on request to the Teacher.
c. The Student (or the Student’s parent or guardian) undertakes not to make photocopies of any music.
d. The Student will not enter any examination, festival, competition or otherwise perform in public without first consulting the Teacher. The Teacher will not enter the Student for any examination, festival, competition or public performance without the approval of the Student (or the Student’s parent or guardian). The Student (or the Student’s parent or guardian) will pay any entry fees for said events.
e. The Student (or the Student’s parent or guardian) is responsible for the insurance of the Student’s instrument.
f. In the interests of the Student’s well-being whilst in the Teacher’s care, the Teacher must be informed of any medical or other condition affecting the Student.
